Terms of service
Terms of Service
These Terms of Service (hereinafter referred to as the "Terms") set forth the conditions for using the online store, products, content, and related services (collectively, the "Services") provided by JEWELRY CASTLE (hereinafter referred to as the "Store"), operated by JDS International Co., Ltd. (hereinafter referred to as the "Company").
When using the Services, these Terms, as well as the Store's Privacy Policy, Return & Refund Policy, Shipping Policy, Legal Notice Under Japan's Act on Specified Commercial Transactions, and other applicable policies, shall apply.
By using the Services or purchasing products from the Store, customers are deemed to have reviewed these Terms and the applicable policies.
Article 1: Use of the Services
When using the Services, customers shall provide accurate and up-to-date information as required by the Company, including their name, address, telephone number, email address, shipping address, payment information, and any other necessary information.
If customers create an account, they are responsible for managing their account information, passwords, and other credentials.
If customers become aware of unauthorized use of their account by a third party, they must promptly contact the Store.
Article 2: Product Information
The Store endeavors to provide accurate product information, images, specifications, and other relevant details whenever possible.
However, product colors, brilliance, textures, and other visual characteristics may appear different from the actual products depending on the customer's device, display, browser, viewing environment, lighting conditions during photography, and other factors.
In addition, jewelry products may have slight individual variations in dimensions, weight, and other measurements stated on the product pages due to manufacturing processes, finishing methods, measurement methods, and other factors.
Article 3: Individual Variations in Gemstones and Jewelry
Diamonds and other gemstones may vary individually in dimensions, proportions, appearance of brilliance, location and characteristics of inclusions, and other features, even when they are of the same type and have the same carat weight, color grade, clarity grade, cut grade, or other quality characteristics.
For products accompanied by a diamond grading report or gemstone identification report, the grading or identification details of the actual gemstone delivered may differ from those shown in product images or sample documents. Unless the Store expressly guarantees the specific grading or identification details of an individual gemstone, images of grading reports and similar documents may be used for reference or illustrative purposes.
Reasonable individual variations arising from the inherent characteristics of gemstones and jewelry shall not, in themselves, constitute product defects.
Article 4: Orders and Formation of Sales Contracts
An order placed by a customer constitutes an offer to purchase products from the Store.
A sales contract between the Store and the customer is formed when the Store confirms the order details and payment or other relevant information and accepts the order.
If there are reasonable grounds relating to order details, payment status, inventory availability, manufacturing feasibility, incorrect price or specification listings, suspected unauthorized use, or other circumstances, the Store may consult with the customer regarding confirmation, modification, or cancellation of the order, either before or after accepting it.
If the Store is unable to accept an order, the customer will be notified through the email address, telephone number, or other contact information provided when placing the order.
Article 5: Prices and Payments
The selling price of each product shall be the price displayed on its respective product page.
Product prices, promotional campaigns, coupons, discounts, and other sales conditions may be changed without prior notice. However, unless otherwise specified, sales contracts that have already been formed shall remain subject to the conditions applicable at the time of ordering.
Selling prices, promotional campaigns, reward points, coupons, and other sales conditions may differ between the Store's official online store and external marketplaces or sales channels, including Rakuten Ichiba.
For payment methods and payment timing, please refer to the Legal Notice Under Japan's Act on Specified Commercial Transactions and the payment information displayed at checkout.
Article 6: Made-to-Order Products
Many products sold by the Store are manufactured on a made-to-order basis.
Made-to-order products are manufactured specifically for the customer after the order details have been confirmed. Therefore, cancellations, returns, or exchanges requested for reasons attributable to the customer are generally not accepted once production has begun.
The standard estimated lead time for made-to-order products is approximately three weeks to one month. However, this period may vary depending on the product, specifications, production status, peak seasons, and other circumstances. If a specific lead time is stated on the product page, please refer to that information.
Article 7: Special-Order Products
Special-order products are procured after an order has been placed. Therefore, cancellations, returns, or exchanges requested for reasons attributable to the customer are generally not accepted once procurement arrangements have begun.
These products are generally expected to be shipped within two weeks after order and payment confirmation. However, the lead time may change depending on supplier inventory availability or other circumstances. The Store will notify the customer if such changes occur.
Article 8: Customized Products
Customized products are based on existing products and involve modifications to precious metal materials, sizes, gemstones, specifications, or other features. Production begins after the specifications have been finalized.
Cancellations, returns, or exchanges requested for reasons attributable to the customer are generally not accepted once production has begun.
The standard estimated lead time is approximately three weeks to one month, although this may vary depending on the nature of the customization.
Article 9: Bespoke Jewelry
Bespoke jewelry is individually created according to designs, gemstones, precious metals, sizes, and other specifications determined through consultation with the customer.
Cancellations, returns, or exchanges requested for reasons attributable to the customer are generally not accepted once the specifications have been finalized or production has begun.
The lead time for bespoke jewelry varies depending on the design, gemstones used, manufacturing processes, and other details. An individual estimated delivery schedule will be provided at the quotation or ordering stage.
If an initial defect is identified in bespoke jewelry, the Store will, in principle, address the issue through adjustments or repairs rather than returns or exchanges, considering the nature of the product.
Article 10: Resizing, Engraving, and Other Alterations
For products that have undergone resizing, engraving, chain modifications, or other alterations requested by the customer, cancellations, returns, or exchanges for reasons attributable to the customer are generally not accepted once the alteration work has begun.
Please refer to the relevant product page or individual information provided by the Store for details regarding available alterations, limitations, fees, and estimated lead times.
Article 11: Returns, Exchanges, and Initial Defects
Returns, exchanges, and refunds shall be handled in accordance with the Store's Return & Refund Policy.
Returns of standard products are accepted under the specified conditions only if the customer contacts the Store within eight (8) days of receiving the product.
Returns or exchanges for reasons attributable to the customer are not accepted for made-to-order products, special-order products, bespoke jewelry, altered products, engraved products, earrings, or other products identified as non-returnable.
If a product has an initial defect or if an item different from the one ordered is delivered, please contact the Store within eight (8) days of receiving the product. After reviewing the product's condition and the order details, the Store will take appropriate action, such as accepting a return, providing an exchange, performing repairs, or taking another suitable measure.
Article 12: Shipping and Delivery
Shipping conditions, shipping fees, dispatch schedules, delivery date and time requests, tracking information, prolonged absence, and other delivery-related matters shall be governed by the Store's Shipping Policy.
Shipping or delivery may be delayed due to weather conditions, traffic, natural disasters, circumstances affecting delivery companies, or other events beyond the Store's reasonable control.
Article 13: Errors in Published Information
The Store endeavors to ensure the accuracy of published product information, prices, specifications, lead times, and other details. However, incorrect information may occasionally be displayed due to typographical errors, data entry mistakes, system malfunctions, or other causes.
If an obvious error is identified in a selling price, product specification, or other published information, the Store will promptly inform the customer of the correct details and may, after consultation with the customer, make appropriate arrangements, including correcting or canceling the order.
Article 14: Intellectual Property Rights
Copyrights, trademarks, and other intellectual property rights relating to product photographs, images, videos, text, articles, logos, trademarks, designs, graphics, and other content published through the Services belong to the Company or third parties holding the legitimate rights to such content.
Except where permitted by applicable law, customers are prohibited from reproducing, republishing, modifying, distributing, selling, publicly transmitting, or otherwise using such content without the Company's prior authorization.
Article 15: Third-Party Services
The Services may use services provided by third parties for payment processing, shipping, analytics, social media, and other functions.
When using third-party services, the terms of use, privacy policies, and other conditions established by the respective service providers may apply.
The Services may contain links to websites operated by third parties. The Store does not guarantee the content, accuracy, security, or other aspects of such third-party websites.
Article 16: Relationship with Shopify
The JEWELRY CASTLE online store operates using the e-commerce platform provided by Shopify.
However, the sale of products through the Store and the sales contracts entered into with customers are conducted directly between JDS International Co., Ltd. and the customer.
Shopify is not the seller of products offered through the Store and does not assume responsibility as the seller for product quality, shipping, returns, exchanges, repairs, or other transactions between the Store and its customers.
Article 17: Handling of Personal Information
Personal information obtained by the Store from customers will be handled in accordance with the Store's Privacy Policy.
Because the Services are provided through the Shopify platform, Shopify may collect and process certain information for the provision and improvement of the Services and other necessary purposes.
For information regarding Shopify's handling of personal information, please refer to Shopify's Privacy Policy.
Article 18: Reviews, Feedback, and Suggestions
The Store may use reviews, opinions, feedback, suggestions, and other information submitted by customers for purposes such as improving the Services, introducing products and services, advertising, promotional activities, and other activities necessary for the operation of its business, while appropriately handling information that could identify individuals.
The Store may decline to publish or may remove submissions that infringe the rights of third parties, contain false information, include defamatory statements, violate public order or morality, or are otherwise considered inappropriate by the Store.
Article 19: Prohibited Activities
When using the Services, customers must not engage in any of the following activities:
- Activities that violate applicable laws, regulations, public order, or morality

Article 20: Changes, Suspension, or Discontinuation of the Services
The Store may modify, interrupt, suspend, or discontinue all or part of the Services when necessary due to system maintenance, technical failures, natural disasters, or other circumstances.
Except in emergencies, the Store will endeavor to provide advance notice of significant changes whenever reasonably possible.
Article 21: Disclaimer and Limitation of Liability
The Store endeavors to ensure the accuracy, security, and continuity of the Services. However, the Store does not guarantee that the Services will always be available without interruption or that all information provided through the Services will be free from errors.
Except in cases involving intentional misconduct or gross negligence by the Store, or where exemption or limitation of liability is not permitted by applicable law, the existence and extent of the Store's liability for damages arising in connection with the use of the Services shall be determined in accordance with applicable law.
Nothing in these Terms shall be construed as unfairly restricting customers' rights under Japan's Consumer Contract Act or other applicable laws, or as exempting the Store from liability that it is legally required to bear.
